Easement Permitting

The District is responsible for the operation and maintenance of each of our dams including the functionality, storage capacity, and safety. Construction, development, excavation and other activity occurring within the District’s easement is subject to the District’s Easement Encroachment Policy.

All activities that encroach in the District Easement Areas and/or Property are prohibited without a permit or an executed agreement with the District. Such activities are reviewed on a case-by-case basis and approval is at District discretion. This includes, but is not limited to, activities of fill, excavation, trenching, aerial and subterranean Encroachments.

Easement and Encroachment Permit review should happen concurrently with plan review by other entities such as the City or County.

District Authority to Regulate Encroachments

The District has review and permitting authority associated with regulating Encroachments in the District’s easements and property to ensure its rights are fully protected or are otherwise remediated for the benefit of the District. The District -owned easements and property authorizes the District to utilize the land for the installation, operation, maintenance and inspection of the dams and to prohibit Encroachments that limit the District’s full enjoyment of the easement conveyed or District Property. 

The District permit review also ensures compliance with the regulatory rules of the by Texas Commission on Environmental Quality (TCEQ), including Title 30, Part 1, Chapter 299 of the Texas Administrative Code (TAC) as currently administered by the Dam Safety Section. 

District Authority to Regulate Construction Activity Beyond Easements

30 Tex. Admin. Code § 299.16(d), as amended, identifies activities near dams that may warrant evaluation by a professional engineer, registered in the State of Texas, at the request of the Dam Owner or the executive director of the TCEQ. The District reserves the right to request such an evaluation for all work that falls within the criteria listed below. Activities may be subject to any changes or amendments to Section 299.16(d), or any other law or regulation applicable to the District. 

The District works closely with a local engineering firm to review and process permit applications for easement encroachments, access, and cut fill agreements.

All of the District’s easements are filed with the Williamson County Clerk’s office. Your surveyor and title company should be able to help you find the easements. Please note the original easements were filed in the late 1950’s and early 1960’s.
